Products
The following general terms and conditions of sale shall be part of all agreements between inBiot and the buyer for any goods sold by inBiot to the buyer, unless otherwise agreed upon in writing by both parties.
The buyer's general terms and conditions are expressly rejected and will be disregarded by inBiot, even if the buyer has previously referenced these terms in connection with a sales agreement.
These terms and conditions will apply alongside inBiot's terms of use and privacy policy, which apply to any legal or natural person who accesses or uses inBiot’s data processing services registered through inBiot’s products.
Los precios presupuestados en un pedido confirmado de inBiot aplicarán a los productos comprados por el comprador.
Los precios de cualquier oferta, confirmación o acuerdo están basados en una logística Ex Works (EXW, última versión INCOTERMS).
Todos los precios están presupuestados como precio neto y no incluyen ningún tipo de tasas o impuestos, los cuales deberán ser pagados por el comprador en la cantidad requerida por la ley en vigor.
Payment must be made within 30 calendar days from the invoice date.
The payment date is the date on which inBiot receives the funds.
All payments must be made to the account agreed upon with inBiot. inBiot reserves the right to request advance payment.All late payments will incur an interest charge of nine and a half percent (9.5%) per year or any applicable higher legal rate, starting from the date payment is fully made. This does not preclude any other rights inBiot may have concerning late payments.
In cases of previous payment issues or doubts about the buyer’s creditworthiness, inBiot reserves the right to require security or advance payment for any shipment.
Products will be delivered Ex Works (EXW, latest version of INCOTERMS) as specified by inBiot, unless otherwise agreed in writing. All risks and responsibilities transfer to the buyer at the time of shipment.
The shipping dates provided by inBiot are approximate unless explicitly stated otherwise.
inBiot will make all reasonable efforts to meet the communicated shipping date, as long as the buyer provides all necessary information for shipment in a timely manner. However, inBiot is not liable if the shipment is reasonably made before or after the communicated date.
inBiot reserves the right to make partial shipments if this action does not adversely affect the buyer.
Under no circumstances is inBiot liable for indirect costs or losses caused by shipping delays or undelivered products.
inBiot is not liable for delayed or defective products or any other breach of its obligations under these terms and conditions or any other agreement between inBiot and the buyer, provided that the event in question is due to unforeseen circumstances or causes beyond its control. This includes strikes, lockouts, labor disputes, inability to obtain labor, public utility services, enforcement of applicable laws, hostile actions, sabotage, war, blockades, insurrections, riots, epidemics, nuclear and radiation activities or consequences, civil disturbances, explosions, fires, or other casualties, or any other cause, whether similar or different from those mentioned, as long as they are beyond inBiot's control. inBiot will notify the buyer as soon as possible of the event in question.
In case of any delay, defect, or failure in fulfilling any obligation, the performance of that obligation will be suspended for a period equal to the delay time, unless that delay exceeds two (2) months, in which case inBiot will terminate the agreement immediately without incurring any liability.
If the buyer fails to meet payment obligations to inBiot, or if there are reasons to believe they will not pay in full or in part, the buyer will be required to return unpaid products to inBiot at their own expense. The buyer agrees to cooperate with inBiot to enable inBiot to retrieve the products in question.
The sale and purchase of products do not imply any transfer or license of intellectual property from inBiot to the buyer or vice versa.
Warranty
inBiot offers a warranty service for all its products of 3 years for products sold in Spain, 2 years for products sold within the EU/UK except Spain, and 1 year for those sold in the US/CAN and other countries.If, after purchasing an inBiot product, you find any defect for which inBiot is responsible and not due to misuse, please contact our Customer Service team at support@inbiot.es and provide the device ID, proof of purchase, purchase date, and a description of the failure. We will contact you as soon as possible to arrange for repair or replacement.
For products outside of warranty, we are happy to repair or replace them according to inBiot's repair rate. Contact our Customer Service team for more information.
Returns
Product returns and cost refunds are not accepted.
Repair and Replacement Policy
Any replacement is subject to inspection by our technicians within 14 days after receiving your return. A response and, if applicable, the shipment of a replacement or repaired unit will be provided within 14 days.
To qualify for repair or replacement within the warranty, you must present the purchase invoice. The product must be shipped in its original packaging or equivalent, including accessories and other items included in the sale. Any product returned missing components or accessories will not be eligible under our warranty policy.
Limited Warranty
inBiot commits to making every effort to promptly remedy any damage caused and to replace the defective product with a functionally equivalent one. All replaced products become the property of inBiot.
inBiot reserves the right to reject any product claimed to be defective if the defect cannot be proven or if no information is provided regarding how the product failed. The product will be returned in its current condition or repaired and returned at the customer's expense according to inBiot's repair rates.
Any repaired or replaced item will carry the remaining warranty of the original product.
Procedure
1. Contact our Customer Service team and provide the device ID, proof of purchase, purchase date, detailed fault description, and collection address.
2. Pack the product in its original or equivalent packaging, including all components.
3. Our team will arrange for the device to be collected from the indicated address. After repair, we will return it to the originally provided address.
4. If the fault is not attributable to inBiot, the customer must pay for the repair according to the rates in effect at that time.
Warranty Exclusions
This warranty will not apply to any product that:
1. Has been modified by any party other than inBiot.
2. Has suffered an accident or misuse.
3. Was damaged during product installation.
4. Was damaged by the system with which it is used.
5. Has suffered liquid damage.
6. Was damaged during transport to our facilities.
7. Has damage to the interface or charging connections.
8. Is counterfeit. Warranty applies only to products with the inBiot brand, serial number, and logo identifying them as such.
inBiot will not provide warranty for any product not manufactured by or with the permission of inBiot.
THIS EXPRESS WARRANTY IS THE ONLY WARRANTY AND REPLACES ALL OTHER WARRANTIES OR SERVICES MENTIONED TO THE BUYER BY THIRD PARTIES OUTSIDE OF INBIOT. INBIOT AND ITS SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES MENTIONED BY THIRD PARTIES FOR COMMERCIAL REASONS OR PARTICULAR PURPOSES. INBIOT IS NOT RESPONSIBLE FOR THE RESULTS OF USE OR FOR THE UNINTERRUPTED OR ERROR-FREE USE OF THE PRODUCT.
IN NO EVENT WILL INBIOT OR ITS SUPPLIERS BE LIABLE TO THE BUYER OR ANY THIRD PARTY UNDER ANY TORT, CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR OTHER LEGAL THEORY FOR ANY COST OF ACQUIRING SUBSTITUTE GOODS, SERVICES OR TECHNOLOGY, LOST PROFITS, DAMAGES OR COMPUTER MALFUNCTION, BUSINESS INTERRUPTION, OR ANY OTHER DIRECT OR INDIRECT DAMAGE OF ANY KIND ARISING FROM THE USE OR INABILITY TO USE THE PRODUCT, EVEN IF INBIOT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE AND WHETHER OR NOT SUCH LOSS OR DAMAGE IS FORESEEABLE.
UNDER NO CIRCUMSTANCES WILL INBIOT'S TOTAL LIABILITY EXCEED AN AMOUNT EQUAL TO THE PURCHASE PRICE OF THE PRODUCT PAID BY THE BUYER THAT IS SUBJECT TO A CLAIM. ANY CLAIM RELATED TO THIS AGREEMENT MUST BE FILED WITHIN THE TIME LIMITS STATED IN THE "WARRANTY" SECTION OF THIS DOCUMENT. FURTHERMORE, INBIOT DISCLAIMS ALL LIABILITY OF ANY KIND FROM INBIOT'S SUPPLIERS.
The product is not a medical device, and inBiot is not responsible for medical claims related to the device.
The Product is not designed, manufactured, or intended for use in hazardous or critical environments or in activities requiring emergency or fail-safe operation, or in any other application or activity where product failure may pose the risk of environmental damage or physical injury or death to humans ("Hazardous Applications"). inBiot specifically disclaims any responsibility or warranty for any use of the Product by the buyer for Hazardous Applications.
This limited warranty statement is the final and complete expression of all agreements between inBiot and the Buyer regarding the subject matter hereof and supersedes any previous or contemporaneous agreements, proposals, or other communications, oral or written, between the parties regarding such matter.
If any of the clauses mentioned above, in part or in full, are legally invalid, the validity of the other clauses shall remain unaffected.
